If the non compliant device CONTRIBUTED to the loss, you lose. Does
not need to be the root cause. They MAY decide to be benevolent and
assign proportional blame and pay a small part of the damage - UNLESS
you have signed anything stating nothing has been modified from code.
Here in California, it's not uncommon to hire a lawyer to help
you get your insurance company to pay on claims. A person without
a lawyer can find that their insurance company either vastly
underpays or won't pay at all.
The ethics of insurance companies appears to be right up there
with the ethics of used car salesmen.
